See Full PDF See Full PDFThe research paper discusses how succession process was conducted under the Luo customary law before the enactment of the succession act 1981 which was intended to consolidate all the laws dealing with succession in Kenya. The study proceeds to give comparison between the provisions of law of succession act and provisions of the Luo customary law in relation to matters of succession. The study then examines and analyses how succession is currently conducted within Siaya County. The aim is to find out whether the law of succession had any effects where it uses land distribution as a tool of analysis. The study analyses those institutions that were created and those that were abolished by the law of succession. As such the study successfully brings out those groups of people that are affected with the same. The study also brings out some of the short comings in the succession act and Kenyan legal system as observed in Siaya County. The study then concludes by presenting its findings on the effects of succession laws on the Luo community of Siaya County. The study proceeds to make recommendations on the short comings by providing the way forward on how to mitigate the effects.
